  9. You should carefully read the following terms and conditions
  10. before using this software.  Unless you have a different license
  11. agreement signed by Nico Mak Computing, Inc. your use of this
  12. software you indicates your acceptance of this license agreement
  13. and warranty.

  15. Shareware Version

  17. Evaluation and Registration

  19. This is not free software.  You are hereby licensed to use this
  20. software for evaluation purposes without charge for a period of 21
  21. days.  If you use this software after the 21 day evaluation period
  22. a registration fee of $29 is required.  Payments must be in US
  23. dollars drawn on a US bank, and should be sent to Nico Mak
  24. Computing, Inc., P.O. Box 919, Bristol, CT 06011- 0919.  Credit
  25. card ordering and quantity discounts are available, as described
  26. in the section Ordering Information/Order Form.  When payment is
  27. received you will be sent a registered copy of the latest version
  28. of WinZip.

  30. Unregistered use of WinZip after the 21-day evaluation period is
  31. in violation of U.S. and international copyright laws.

  33. Distribution

  35. Provided that you verify that you are distributing the Shareware
  36. Version (select About from the WinZip Help menu to check) you are
  37. hereby licensed to make as many copies of the Shareware version of
  38. this software and documentation as you wish; give exact copies of
  39. the original Shareware version to anyone; and distribute the
  40. Shareware version of the software and documentation in its
  41. unmodified form via electronic means.  There is no charge for any
  42. of the above.

  44. You are specifically prohibited from charging, or requesting
  45. donations, for any such copies, however made; and from
  46. distributing the software and/or documentation with other products
  47. (commercial or otherwise) without prior written permission, with
  48. one exception:  Disk Vendors approved by the Association of
  49. Shareware Professionals are permitted to redistribute WinZip,
  50. subject to the conditions in this license, without specific
  51. written permission.

  55. One registered copy of WinZip may either be used by a single
  56. person who uses the software personally on one or more computers,
  57. or installed on a single workstation used nonsimultaneously by
  58. multiple people, but not both.

  60. You may access the registered version of WinZip through a network,
  61. provided that you have obtained individual licenses for the
  62. software covering all workstations that will access the software
  63. through the network.  For instance, if 8 different workstations
  64. will access WinZip on the network, each workstation must have its
  65. own WinZip license, regardless of whether they use WinZip at
  66. different times or concurrently.

  70. This agreement shall be governed by the laws of the State of
  71. Connecticut.

  73. Disclaimer of Warranty

  75. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  76. WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY
  77. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  In particular,
  78. there is no warranty for the optional virus scanning feature
  79. (WinZip does not scan for viruses, it simply runs external
  80. programs that claim to perform this function).  Because of the
  81. various hardware and software environments into which WinZip may
  82. be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS
  83. OFFERED.

  85. Good data processing procedure dictates that any program be
  86. thoroughly tested with non-critical data before relying on it.
  87. The user must assume the entire risk of using the program.  ANY
  88. LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT
  89. REPLACEMENT OR REFUND OF PURCHASE PRICE.
